SQFT PAINTING LIMITED WARRANTY AGREEMENT
1. Coverage & Scope
SqFt Painting (“Company”) warrants labor and materials for a period of three (3) years from the date of final project completion and full payment. If paint failure (such as peeling, blistering, or flaking) occurs within this window due directly to defective workmanship or materials applied by the Company, the Company will supply the necessary labor and materials to remediate the affected area at zero cost to the client.
2. Sole & Exclusive Remedy
This limited warranty is expressly in lieu of all other warranties, written or oral, express or implied. The sole responsibility and liability of SqFt Painting under this warranty is strictly limited to correcting the specific area of failure as evaluated and approved by the Company. In no event shall the Company be liable for incidental, special, consequential, or indirect damages of any kind.
3. Specific Property & High-Wear Exclusions
To the fullest extent permitted by law, this warranty strictly excludes coverage for performance failures, wear, or deterioration on the following:
- High-Touch & High-Traffic Surfaces: Cabinet doors, cabinet drawers, passage doors, sidelights, door frames, handrails, baseboards, and any other surfaces subject to regular physical contact, handling, impact, or friction.
- Horizontal & Walking Surfaces: All horizontal walking or standing surfaces, including but not limited to decks, porch floors, patios, steps, treads, thresholds, and walkways.
- Weather & Solar Exposure: Exterior surfaces subject to severe, direct, or prolonged exposure to sunlight, UV radiation, rain, wind, hail, or extreme temperature fluctuations.
4. Mandatory Pre-Inspection & Fault Assessment Procedure
Prior to the approval or authorization of any warranty service, repair, or refund, the Company must be granted physical access to perform an on-site inspection of the claimed area.
- Determination of Cause: The Company retains sole discretion to inspect, test, and evaluate the affected surfaces to determine the root cause of the failure before accepting liability or initiating corrective action.
- Denial of Coverage: If the Company’s inspection reveals that the failure resulted from any excluded condition (including but not limited to underlying substrate failure, external physical damage, environmental conditions, moisture intrusion, or high-contact wear), the warranty claim shall be formally denied, and the Company shall have no liability or repair obligation.
- Access Requirement: Failure by the Customer to provide prompt access for an inspection within thirty (30) days of filing a claim invalidates this warranty for the reported issue.
5. General Exclusions & Limitations
This warranty does not cover paint failure, damage, or substrate breakdown caused by:
- Structural settlement, building movement, substrate expansion/contraction, or cracks occurring after job completion (cracks properly prepared at project start are not guaranteed against re-cracking).
- Moisture intrusion, water damage, leaks, humidity, mildew/mold growth, or underlying wood rot.
- Physical abuse, neglect, chemical exposure, power washing, animal damage, accident, or improper cleaning.
- Concealed defects, unsealed substrates, or previous paint coats applied prior to the Company’s work that fail beneath the new application.
6. Standards of Workmanship
All approved warranty work will be completed in accordance with Painting and Decorating Contractors of America (PDCA) standards. Evaluation of a “properly painted surface” shall be determined when viewed without magnification from a distance of five (5) feet or more under normal lighting conditions.
